ADVERSE POSSESSION: OPEN OCCUPATION OF REAL PROPERTY WITHOUT TITLE OR PERMISSION OF THE PERSON HOLDING TITLE

Sa porma pa lang ng pinagsanib na DB GLOBAL OPPORTUNITIES at National Home Mortgage Finance Corporation (NHMFC) ay kaduda-duda na porke may merger sila noong panahon ni Ate Glo para lang daw mandugas ng mga lehitimong homeowner who had own properties thru adverse possession nationwide?

Ang DB Global Opportunities a.k.a. Balikatan Housing Finance Incorporated (BHFI) or Bahay-Financial or BFS ay isang private company, samantalang ang NHMFC naman ay isang government owned and cotrolled corporation (GOCC). Pinagsama silang a la sindikato para bawiin ang 52,000 housing units mula sa mga lehitimong homeowners sa buong bansa na hindi raw nagbabayad ng hulog sa bahay payable in 30 years?

Kung hindi man nagbabayad ang mga lehitimong homeowners ng kanilang monthly amortization sa Balikatan para sa mga nabili nilang RIGHTS ng low cost housing, ay nagbabayad naman sila ng amilyar kada taon sa Gobyerno, samakatwid, kumikita ang Gobyerno mula sa kanila, 'di ba? 

Labis na iniinda ng 52,000 homeowners nationwide ang epekto ng highway robbery ng sindikato sa kanila, kasabwat ang Register of Deeds (RD), hoodlums-in-robe, BIR, Treasurers' at Assessors' Offices since Ate Glo's Administration, kasi, bakit ayaw umabante ang imbestigasyon ng Committee on Housing and Urban Development ng House of Representatives? MagkANO ba ang dahilan?

Batay sa report posted on the Internet by the House of Representatives, inamin mismo ni Federico Cadiz, Jr., vice president and Director of BHFI, his company's operations: "x-x-x that of the 52,000 accounts under their management, some 47,000 borrowers applied for a loan restructuring through an appraisal-based refinancing. He said that BHFI has initiated the foreclosure of some 9,600 accounts x-x-x" (emphasis mine)

Sinabi pa sa report: "On the other hand, Joseph Peter Sison, president of the NHMFC, explained that the sale of its non-performing loans is part of the overall strategy to rehabilitate NHMFC financially x-x-x the sale involved only the high-delinquency loans composed of some 52,000 units under the Unified Home Lending Program (UHLP) funded by the Pension Funds, namely, the Home Development Mutual Fund (HDMF), Social Security System (SSS), and Government Service Insurance System (GSIS)." (emphasis mine)

Noong 1990 under Tita Cory's watch, ay boom sale ang low cost housing saan mang dako sa Pilipinas at kada housing unit na biniling hulugan ay inilalagay sa Title ang pangalan ng nakabiling Overseas Contract Workers (OCWs), now, OFWs, pero annotated ng mortgaged ang titulo, sa katumbas na halaga ng biniling property payable in 30 years.  

Ang tanong: Mga totoong tao ba ang OFWs na buyers ng housing units na awtomatikong ipapangalan sa kanila ang Title ng property pero annotated naman ang Title ng mortgaged, sa utos ng sindikato? Ang sagot: HINDI! Kung matatandaan, walang pagkakaiba ito sa pandurugas noon ng bilyon-bilyong piso sa Pampanga ng syndicated estafa convict Delfin Lee, na hanggang ngayon ay nagtatago, 'di ba? 

So, matapos makubra ng Developer mula sa UHLP, a Government entity, ang multi-million pisong bayad sa kanyang proyekto, ay hindi na ngayon makasingil ang Pension Funds mula sa OFWs na nagsibili ng housing units, porke, ginamit lang ang mga pangalan nila, kung totoong tao nga sila, bilang recipients of housing loans by the developer, kagaya nga ng modus-operandi ni Delfin Lee. Samakatwid, peke, porke wala namang aktuwal na tao ang totoong bumili at omokupa sa housing unit(s). Maliwanag na magkaiba ang pekeng original buyer kesa adverse claimant na patuloy na nililigalig ng sindikato.

Ito ang dahilan kung bakit mahigit 90% occupants by adverse possession of low cost housing projects nationwide na pawang biktima ng harassment ay pawang kualipikadong mag-avail ng adverse claim sa ilalim ng SECTION 70, P.D.No. 1529. Heto ang legal meaning ng Adverse Possession: Open occupation of real property without title or permission of the person holding title.   

ANA: "Section 47 ang laging ginagamit na pang-kontra ng RD vs Section 70, para hindi maisyuhan ng new title na tax exemp ang sinomang homeowner na qualified mag-avail nito. Quasi-judicial ba ang RD?"

LISA: "Ganire kasi ang mandato ng Section 47 of PD 1529 - No title to register land in derogation of the title of the registered owner shall be acquired by prescription or adverse possession. Ito mismo ang batas o butas na PALUSOT ng RD, ang cheap, 'di ba?"

CION: "Bakit, meron ba kasing derogation, meaning, substantial change of the title with the same technical description, kung ipapangalan ito sa adverse claimant, na totoong tao, ang new title, kapalit ng unang titulo na nasa pangalan ng fictitious owner(s)?"
