ORIGINAL TITLE TO PROPERTY BY ADVERSE POSSESSION

Isa ako sa 52,289 homeowners nationwide under threat of losing their homes through foreclosure by Balikatan, kaya ako'y nagsadya noong May 27, 2013 sa Rizal Provincial Treasurer's Office para kumuha ng kopya ng Certificate of Sale ng aking property na isinubasta ng hindi ko alam noong July 22, 2010.

Doo'y ipinakita ko sa receptionist ang annotation sa Memorandum of Encumbrances, page 5 ng titulo, ang Certificate of Sale, upang humingi ng paliwanag at kopya ng certificate of sale kung bakit naisubasta ang aking property noong July 22, 2010 sa Balikatan bilang highest bidder daw.

Is there another insidious scandal-in-the-offing a la Delfin Lee's Globe Asiatique that has been simmering awhile under the radar?

Nilinaw ko sa kanila na inokupahan ko ang naturang property and made improvements thereon mula January 2000 at namumunga na lahat ang mga tanim kong puno ng manggang de kalabaw, kaimito, atis, bayabas, etc., batay sa Tax Declaration na hawak ko petsa September 14, 1999.

Subalit wala sa file ng Provincial Treasurer na kabilang ang property ko sa mga nakaraang public auction nila, kung kaya ako'y agad na nagtungo sa Antipolo Hall of Justice, sa Office of the Clerk of Court & Ex-Officio Sheriff, at doo'y nakumpirma kong ang Korte nga ang nagsagawa ng subasta, so that I obtained from them a copy of certificate of sale of the property with TCT-599677 in the name of a fictitious couple, in favor of Balikatan Housing Finance, Inc. and signed by the Sheriff/Clerk of Court, the Sheriff-in-Charge, and approved by the Executive Judge dated July 22, 2010.

 Ayon sa batas, "A title by adverse possession is a title acquired against the consent of the owner. It is obtained by wrongful entry and continuous possession for a time fixed by state law - 10 years in most cases. Suppose, for example, that Jones farms Smith's land for over 10 years against Smith's consent, but Smith does not take legal action against Jones for using the land, Jones then has ORIGINAL TITLE BY ADVERSE POSSESSION.

"A title to property may be acquired in many ways. If a person buys a property from another person or received it as a gift or through a will the title is derivative.

ANA: "Noong January 2000 pa pala lumipat ang pamilya ni Sir Leo sa Taytay, Rizal mula Quezon City noh? Over 10 years na silang nakatira roon bago sinubasta ang kanyang property, eh, puede ba 'yon?"

LISA: "Hindi puede. Sobra na kasi sa 10 years bago nagkaroon ng legal action ang FICTITIOUS registered owner sa pamamagitan ng Balikatan. Tapos na ang prescription period, o, 'di ba?"

CION: "Prescription is the mode of acquisition to title of land by long use and enjoyment."
