Pero bakit pati ang Ombudsman eh tila WALANG MAGAWA???

FACT: "This pertains to the letter-complaint of (Opac)oaparagonasaball, a resident of Blk x, Lot xx, Palmera Subd, filed on May 28, 2012, assailing the alleged extortion activities of the newly elected members of the BOD of Palmera Homeowners Assn, Inc (PHAI), and the dismissal of the complaint against the latter pursuant to the Resolution dated February 21, 2011 penned by MARIA RONATAY, 4th Asst Prosec.

"In substance, the complainant avers the following:

"On May 13, 2010, he executed a complaint-affidavit against the fictitious members of the Board of Advisers and the newly elected members of the BOD of PHAI for violation of Art. 172, par. 1, and Art. 176 of the RPC, for continuously collecting unlawful fees from the members of PHAI.

"On February 21, 2011, Ronatay dismissed the complaint.

"On May 16, 2011, Opac filed a Motion for Reconsideration.

"The motion was denied, pursuant to Memorandum dated June 22, 2011.

"On July 11, 2011, Opac filed a Petition for Review with the DOJ.

"A Resolution was promulgated on Jan 30, 2012 dismissing the petition.

"X-x-x   x-x-x. . ."

Last para. before dispositive portion: "As regards the alleged extortion activities undertaken by the members of the BOD of PHAI, the same cannot be cognizance of by this Office, in the absence of allegation and proof that they are public officials or employees. X-x-x-x  x-x-x. .

"FOREGOING CONSIDERED, the present complaint is DISMISSED."  

ANA: "Bakit nadismis? Wala kayang pang-lagay si Opac? Ano ba kasi ang reklamo at sino-sino ang nireklamo niya, ha?"

LISA: "Ang TRIPARTITE!!! Nagkutsabahan ang Manila Water (MWSS), ang Subdivision Developer (Senator) at ang pekeng BOD para mangolekta mula sa homeowners ng P438 monthly for 3-yrs para bayad daw sa RIGHT-OF-WAY ng mainpipes na ibinaon ng Manila Water sa gitna ng kalsada patungo sa kada unit ng buong subdibisyon."

CION: "Naka-reflect sa monthly billing ng Manila Water ang halagang P438 bilang Other Charges kada consumer bilang patong na halaga sa kuwenta ng buwanang konsumo nila sa tubig. Eh hindi ba extortion ang tawag doon at ang utak ng extortion eh ang TRIPARTITE na taga-MWSS at isang Senador?
